These Terms of Service ("Terms" or "Agreement"), together with our Privacy Policy, constitute a legally binding agreement between you ("User" or "you") and Derysa ("we," "us," or "our"). They govern your access to and use of the Derysa mobile application, website, and related services (collectively, the "Service").
By downloading, accessing, or using the Service in any manner (including browsing, creating an account, or contacting us), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to all of these Terms, you must not access or use the Service.
2.1 To use certain features, you must register an account. You agree to provide accurate, current, and complete information during registration and to keep it updated. You are solely responsible for all activities under your account and maintaining the confidentiality of your login credentials.
2.2 You represent and warrant that you:
- Are a natural person and at least the age of majority in your jurisdiction.
- Are not a resident of any jurisdiction where the Service is prohibited ("Restricted Jurisdiction").
- Have the legal capacity to enter into this contract.
- Will not impersonate any person or entity or misrepresent your affiliation.
2.3 We reserve the right to refuse registration, suspend, or terminate your account at our sole discretion, with or without notice, for any reason, including if we suspect you violate these Terms, provide false information, or are from a Restricted Jurisdiction.
You are solely responsible for all content you create, upload, transmit, or display through the Service ("Your Content").
3.1 You agree NOT to use the Service to:
- Engage in any unlawful, fraudulent, harassing, defamatory, abusive, or harmful activity.
- Infringe upon the intellectual property, privacy, or other rights of others.
- Share content that is obscene, pornographic, violent, or promotes hate speech.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Use automated scripts, bots, or any means to scrape, data mine, or overload our infrastructure.
- Circumvent any access or fee structures of the Service.
- Misrepresent your identity or the origin of any content.
- Engage in commercial activities (e.g., advertising, sales) without our prior written consent.
3.2 Interactions with Others: The Service may allow you to interact with other users. You are solely responsible for your interactions. We do not screen users and make no representations about user conduct. Any offline meetings or sharing of personal information are at your own risk. We encourage you to report abusive behavior to us and local authorities if necessary.
3.3 No Endorsement: We do not endorse, control, or assume responsibility for any User Content or user conduct. We may, but are not obligated to, monitor, review, or remove User Content at our discretion, especially if we believe it violates these Terms or is harmful.
4.1 Our Property: The Service, including its design, features, graphics, logos, and all software and proprietary technology, are owned by or licensed to Derysa and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.
4.2 Your Content: You retain ownership of Your Content. By submitting Your Content, you grant Derysa a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform Your Content in connection with operating, providing, and improving the Service.
4.3 Prohibitions: You may not copy, modify, distribute, sell, or lease any part of the Service or our intellectual property without our express written permission.
5.1 The service is provided on an "As is" And "As available" Basis, without warranties of any kind, either express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
5.2 To the fullest extent permitted by law, derysa and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the service.
5.3 Our total liability to you for any claim arising out of or relating to these terms or the service shall not exceed the amount you have paid to us in the past six months.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately. You may also terminate your account at any time via the Service.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms within the Service and updating the "Effective Date." Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
